Please read the following terms and conditions carefully, before you use this website.

These Terms and Conditions govern the use of the Pacific Vision Webshop and the purchase of any products or services from the Pacific Vision Webshop.

By accessing the Pacific Vision Webshop and viewing its material and/or purchasing products or services you acknowledge that you have read and understood these Terms and Conditions and agree to abide by them. If you DO NOT agree to these Terms and Conditions then you should terminate your connection with the Pacific Vision Webshop.

You may browse, view, print, and copy portions of this website ONLY for the purpose of making decisions about items that you may wish to buy and you may not use this web site or any of the material within for ANY OTHER purpose whatsoever.
Disclaimer
1. The information relating to product or service gifts displayed on this Website is sourced from a variety of manufactures and suppliers and we display it in good faith. We make all reasonable efforts, at the time of display, to ensure that the information is accurate but due to the fact that at any time manufactures and suppliers can make model changes, specification changes, packaging changes, and service offering changes without prior notification, we are unable to warrant that the information on the Website will be totally accurate at all times and in respect to all products or services.
2. You acknowledge that information on the site that does not relate to actual product or service specifications is reproduced for general informational purposes only and that it is your responsibility to make decisions regarding the suitability of a product or service for the purpose you have in mind.
3. To the extent permitted by the applicable law, the Pacific Vision Webshop disclaims all warranties with respect to products and services, either express or implied, including but not limited to any implied warranties of merchantability or fitness for any particular purpose.

Limitation of Liability
1. the Pacific Vision Webshop and its owners will not be liable to you for any loss or damage arising directly or indirectly in connection with the supply to you of goods or services from the Website except to the extent that such liability is not lawfully excluded under the applicable law.
2. the Pacific Vision Webshop and its owners expressly exclude liability for indirect, special, incidental or consequential loss or damage which may arise as a result of supplying goods or services to you in respect of other equipment or property, or for loss of profit, business, revenue, goodwill or anticipated savings.
3. In the event that any exclusion contained in these Terms and Conditions is held to be invalid for any reason and the Pacific Vision Webshop becomes liable for loss or damage that may lawfully be limited, such liability shall be limited to the amount originally paid by you to acquire the goods or services, or the repair or replacement of the goods, at our discretion.

Prices:
1. Prices are shown in New Zealand Dollars (NZ$) and include: GST (Goods and Services tax) at 15%.
2. You agree that prices shown on our website do not constitute an offer on our part and that we retain the right to correct any price that is incorrectly displayed at the time that we confirm your order. You agree that the order confirmation we send you is an invitation and it is your prerogative to accept or decline that invitation on receipt.
3. Pricing is valid for online ordering only. Though we are happy to give you further information by email or phone, we cannot send you quotes and / or invoices other than the ones provided through the Pacific Vision Webshop.
4. A 2.5% surcharge on credit cards is included in the displayed prices.

Shopping and payment:
1. You can order products shown on the Pacific Vision Webshop on-line only.
2. You can pay for your order by credit card only at this stage.
3. If you opt to pay for your order by credit card, you warrant that:
a) You are the owner of the card the details of which you have provided on the order and are legally entitled to use the card.
b) You are in possession of your card at the time of ordering and you have not misplaced the card or the card has not been stolen, or cancelled.
c) You have sufficient funds on the card quoted in order to complete the purchase.
d) The order you are placing is a bona-fide order which you have every intention of completing.
4. If you order on-line, we will quickly send (to the email address supplied by you) an automatic email notice that we have received your order. This notice does not necessarily mean that your order is confirmed or approved.
5. If you cancel your order after receipt of order confirmation from us then we reserve the right at our sole discretion to deduct a re-stocking fee of NZ$ 10.00 per item from any credit.
6. None of these provisions affect any relevant statutory rights you have under New Zealand consumer protection or sales of goods, law.

Warranty and use:
The equipment is warranted against any manufacturing defects for a period of 12 months unless stated otherwise, when used in a normal, responsible manner.
Software: unless stated otherwise, the right for a single person to use the software is purchased.

Applicable Law:
These terms and conditions and any dealings between you and the Pacific Vision Webshop are governed by the law of New Zealand and any disputes will be decided exclusively by the courts of New Zealand.
